RegulationsResolution No. 153 ESTABLISHING POLICY REGARDING SEWER CLEANOUTSRESOLVED, by the Sanitary Board of the Burbank Sanitary District, County of Santa Clara, State of California, that WHEREAS, a specific stated policy regarding the responsibility of Sewer Cleanouts has not been established; WHEREAS, it appears and it is hereby found, determined and declared that it will be for the best interest and to the advantage of said District to state the policy; NOW, THEREFORE, IT IS RESOLVED, DETERMINED AND ORDERED by the Sanitary Board of the Burbank Sanitary District, that the stated policy regarding Sewer Cleanouts is as follows: 1. DEFINITIONS. A. District Sewer Lines: Those lines lying within public right-of-way, including main lines. Service laterals extending from main lines to the street right-of-way/property line shall also be considered District lines so long as a clean-out has been provided not closer than three (3) feet toward the building being served from the boundary of the public right-of-way, property line, or edge of sidewalk nearer the building being served. B. Private Sewer Lines: Those sewer service mains and laterals extending from the public right-of-way/property line to the building being served. 2. CLEANOUT PROVIDED ON PREMISES – When a cleanout is provided as specified in Item 1, subitem A, any work within the Private Sewer Line is the responsibility of the property owner. Any work within the District Sewer Line is the responsibility of the District. 3. CLEANOUT NOT PROVIDED ON PREMISES – In the event that a cleanout is not provided as specified in Item 1, subitem A, the property owner shall be responsible for the work required to install a cleanout. Once the cleanout is installed, the responsibility for the work is as specified in Item 2 above. In no case shall a Contractor or private individual install a cleanout within the public right-of-way/property line without specific prior authorization by the District. If the property owner does not authorize a cleanout to be installed, the work within both the Private Sewer Line and the District Sewer Line is the responsibility of the property owner. 4. In either of the above cases specified in Items 2 and 3, the Contractor or private individual shall not service the District Sewer Line without specific prior authorization by the District. 5. When applicable, or unless a public nuisance is evident, District will not perform work within the District Sewer Lines without prior authorization from the owner or resident of the building being served. 6. This resolution is in accordance with appropriate sections of Burbank Sanitary District Ordinance No. 5. Approved: 03Jun93
